PLEASE READ THE FOLLOWING OREGON MOTORCYCLE TOURS CONTRACT TERMS & CONDITIONS /
INDEMNITY & RELEASE FORM VERY CAREFULLY BEFORE SIGNING.

1. Services included: The price of a Oregon Motorcycle Tours (“OMT”) tour includes motorcycle rental, all lodging, all scheduled meals, motorcycle theft / collision / third party liability insurance and tour operator(s).

2. Services not included: The price of a OMT tour does not include fuel, airfare, lodging before the first scheduled day of the tour, lodging after the last scheduled day of the tour, unscheduled meals, alcoholic beverages, personal items, phone calls, souvenirs, film.

3. Payment: OMT accepts payment via Visa, MasterCard, Discover, American Express PayPal or Check. All payments must be made in United States dollars. Full payment for a OMT tour must be received no later than thirty (30) days prior to a scheduled tour unless an agreement is made between OMT and a OMT customer. A minimum down payment of five hundred dollars ($500) per person must be made to reserve a spot in a OMT tour. Full payment of the tour cost may be made at time of reservation.

4. Billing: If a OMT customer reserves a tour with a down payment, final payment will be automatically billed to your Credit Card thirty (30) days prior to reserved tour date. Money Order or Check in United States dollars must be received by OMT thirty (30) days prior to the first scheduled day of the tour. To change method of payment, contact OMT prior to sixty (60) days before scheduled tour.

5. Motorcycle Insurance: Motorcycle theft, collision, and third party liability insurance is included in the tour cost with a deductible of $2,000 for theft and $2,000 for damage. A standard $500 security deposit is required at the beginning of the tour. The security deposit may be lowered to $300 lowering the deductible to $1,000 for theft and $1,000 for damage for an additional $6 per day.

6. Customer cancellation: OMT customers may cancel a tour at any time. If a OMT customer cancels a reservation prior to thirty (30) days before the first scheduled day of the tour, OMT will refund the full amount of prior payment(s) less a two hundred dollar ($200) processing fee. Refunds will not be given to cancellations requested less than thirty (30) days prior to a reserved tour. However, the total amount of any unused tour payment may be credited toward any other OMT tour within two (2) years of the cancellation date. No refund is given to OMT customers who do not show up for a scheduled tour or who miss portions of a tour. Because of the slim chance of illness, airline inefficiency, or other unforeseen situation that may cause an OMT customer to miss a scheduled OMT tour, OMT suggests that customers purchase travel / trip cancellation insurance.

7. Cancellation of trip: OMT reserves the full and exclusive right to cancel any scheduled OMT tour at any time because of natural disaster, political unrest, severe inclement weather, or for any other reason whatsoever. If OMT cancels a tour, the OMT customer will be notified immediately. The OMT customer will have two options: 1) to reschedule to another OMT tour or 2) to receive a full refund on all payments made to OMT including all deposits, payments, and processing fees.

8. Denial or dismissal: OMT strives to provide safe and enjoyable tours for all OMT participants. Because of this, OMT reserves the right to accept or deny any individual or party from participating in a OMT tour for any reason whatsoever. OMT does not discriminate against any particular race, religion, color, ethnic background, sex, or handicap. However, a OMT employee or tour operator may dismiss for any reason an individual or party if the OMT employee or tour operator feels the individual or party is a danger or a disruption to himself or herself or the group. Dismissed OMT participants are responsible for all transportation, accommodations, and costs incurred as a result of their dismissal. No refunds will be given to individuals who are dismissed from a OMT tour once the tour begins.

9. Driver qualifications: Drivers for OMT motorcycles and/or motorcycles rented from any other rental agency must be at least twenty-one (21) years old. Drivers must have a valid international motorcycle license or a valid motorcycle license issued from his or her country of residence. Drivers must have at least two (2) years riding experience on a motorcycle with an engine size equal to or greater than six hundred fifty cubic centimeters (650cc).

10. Physical condition, alcohol, and drugs: All OMT participants , by signing this contract, hereby represent that they are in sound medical condition capable of participating in the OMT tour without risk to themselves or others. OMT participants are responsible for riding at your own level of competence at all times during a OMT tour or other related activity even when following or riding behind a OMT tour leader. At no time should any OMT participant exceed or try to exceed riding limitations or traffic laws. OMT participants are furthermore prohibited from driving a motorcycle during a OMT tour while intoxicated on alcohol or other illegal drugs. By signing this document the OMT participant agrees that he or she is fully responsible for all his or her own actions while driving or riding on a motorcycle and at all other times day or night throughout the duration of the OMT tour.

11. Photo release and waiver:Unless otherwise requested in writing, I do hereby give OMT the right to use my name, picture, portrait, or photograph in all forms and media and in all manners, including composite, for advertising, for publication or any other lawful purposes, and I waive any right to inspect or approve the finished product, including written copy, which may be created in connection therewith.

12. Regardless of modification, invalidation, or any changes to one clause of this contract, all unaffected portions of this contract remain valid as a whole.

13. This document, except where voluntarily supplemented by the “Assumption of Risk and Waiver of Liability” document, supersedes any and all verbal and/or other written agreements made between OMT and the OMT customer and/or participant.

14. This document is created as a contract between Oregon Motorcycle Tours, and the individual or party who signs this document . All disputes between OMT and the individual signing this document will be settled in the courts of the state of Oregon in the United States of America.

 

I, being of sound mind, have read and understand the Oregon Motorcycle Tours Contract Terms and Conditions and accept all of the terms and conditions therein.
